1. USCIS has decided to use the Dates for Filing chart for the purpose of filing I-485 in November.
According to the USCIS, "USCIS will not accept any new employment-based fifth preference adjustment of status applications based on the Regional Center Program until that program is reauthorized. For all other employment-based preference categories, you must use the Dates for Filing chart in the Department of State Visa Bulletin for November 2021."
2. Your I-485 cannot be approved until your priority date (PD) is current under the Final Action Dates chart.
3. The citation requirement of EB1A is much higher than that was required before. You are entitled to the Priority Date (PD) of your first-approved I-140. If you were born in India or China Mainland and are now thinking about filing an EB1A case, you may consider filing an NIW petition as soon as possible to secure an earlier PD.
